Gezirota Terms of Use

1. Scope and Acceptance

These Terms of Use govern the website, trip planner application, guide pages and all associated data files (the "Platform") provided under the gezirota.tr domain and its sub-paths.

By visiting the Platform, using the application or accessing any data through it, you accept these terms. If you do not accept them, do not use the Platform.

These terms may be updated without prior notice. The version published on this page is always the version in force.

2. Nature of the Service and Disclaimer

The Platform is an informational and trip-planning tool covering places to visit in Türkiye, Iceland, and Portugal. Scores, durations, route suggestions and venue details are compiled from publicly available sources and processed algorithmically.

Important: Information on the Platform is not guaranteed. Opening hours, fees, accessibility and the current status of venues may change. Verify with the relevant official source before making travel decisions. The Platform cannot be held liable for damages arising from the timeliness or accuracy of information.

3. Legal Disclaimer and Advisory Notice

All route, venue, duration, and map data provided on the Platform are intended to guide users in their travel planning. When using the Platform, you must consider the following:

Estimated Distances and Travel Times: Distances and travel times displayed on the site are calculated using the open-source routing engine OSRM (Open Source Routing Machine) under standard road conditions. Live traffic congestion, road construction or repair works, temporary or seasonal road closures, ferry schedules, severe weather conditions, and border crossings are not accounted for; actual travel times may vary substantially.
Advisory Nature of Routes and Pre-made Tours: Route recommendations, corridors, and pre-made itineraries offered by the Platform are solely for inspirational and advisory purposes. The suitability of any route must be assessed by the user taking into account individual driving competence, vehicle specifications, travel companions, and comfort preferences.
Venue Scores and Compilations: Place scores and popularity rankings presented on the site are derived from algorithmically aggregated public visitor evaluations; they do not represent an official assessment or rating by any public institution or tourism authority.
Artificial Intelligence (AI) Generated Plans: Itineraries created via the "Plan with AI" feature are powered by generative artificial intelligence. AI responses may contain inaccurate, incomplete, geographically impractical, or outdated information. Any AI-generated plan must be verified against maps and official sources before being relied upon.
Weather Forecasts: Weather information is provided via real-time estimates from third-party meteorological services (Open-Meteo); it is strictly indicative and may not capture localized mountain storms or sudden climatic shifts.
Opening Hours, Admission Fees, and Accessibility: Operating hours, admission prices, reservation requirements, renovation closures, and road accessibility for points of interest are subject to change without notice. Visitors must independently confirm operating status with official venue sources prior to departure.
Nature, Mountain, Driving, and Personal Safety: All safety decisions, route choices, and risk assessments concerning hiking trails, mountain passes, adverse weather, winter driving, wildlife, and natural hazards remain the sole responsibility of the user.
Third-Party Sites and Services: Gezirota accepts no liability for service interruptions, inaccurate data transmission, or content provided by third-party infrastructures such as map tile servers, routing engines, geocoding search, weather services, or linked external websites.

4. Intellectual Property and Database Rights

All content on the Platform — text, guide articles, design, interface, imagery, brand elements and in particular the place dataset — belongs to Gezirota and is protected under Turkish Law No. 5846 on Intellectual and Artistic Works and related legislation.

The place dataset is the result of selecting, verifying, filtering, classifying, scoring and arranging raw data gathered from public sources into an original structure. This compilation required a substantial investment in both qualitative and quantitative terms and falls within the scope of database maker's rights under Additional Article 8 of Law No. 5846.

The fact that individual data items may be found in public sources does not legitimise the unauthorised extraction of the compilation as a whole or of a substantial part of it.

5. Prohibited Uses

The following are expressly prohibited:

Extracting, downloading or copying all or a substantial part of the dataset by automated means (crawler, scraper, bot, script, headless browser);
Systematic access to data files (*.json, *-poi.js and similar) outside the application interface;
Republishing, selling, licensing or converting the content or dataset into a derivative data product for commercial purposes;
Using the dataset to train artificial intelligence or machine learning models (our robots.txt and ai-train=no directives separately refuse this use);
Attempts to circumvent access limits, rate limits or technical protection measures;
Reproducing the dataset as a whole or a substantial part of it on another platform, even with attribution.

6. Traceability of the Dataset

Notice: The Gezirota place dataset contains traceable distinguishing marks that allow its origin to be identified. These marks do not affect user experience or the fitness of the data for its intended purpose; however, where the dataset has been copied without authorisation, they are capable of demonstrating that the copy originates from Gezirota.

The nature, location and detection method of these marks are not disclosed. Where unauthorised copying is detected, these records are used as evidence.

7. Permitted Use

The following are permitted:

Using the Platform for personal, non-commercial travel planning;
Downloading, printing and personally sharing the trip plans you create;
Linking to Platform pages;
Quoting to a limited and reasonable extent for news, academic work or review purposes, with attribution and a link.

8. Limitation of Liability

The Platform is provided "as is". No warranty is given that it will operate uninterrupted or error-free. Gezirota cannot be held liable for direct or indirect damages arising from the use of, or inability to use, the Platform.

Gezirota is not responsible for the content of third-party sites linked from the Platform.

9. Consequences of Breach

In the event of a breach of these terms, Gezirota reserves the right to restrict or block access and to apply technical measures without prior notice.

In cases of unauthorised data extraction or unauthorised use of the dataset, all legal remedies will be pursued, in particular the civil and criminal remedies under Law No. 5846 and the unfair competition provisions of Turkish Commercial Code No. 6102.

10. Governing Law and Jurisdiction

These Terms of Use are governed by Turkish law. The courts and enforcement offices of the Republic of Türkiye have jurisdiction over any disputes.

The Turkish version of this text prevails; translations into other languages are for information only and, in case of conflict, the Turkish text applies.
